Tax

Members of the Tax team, cover not only corporate taxation and the fiscal implications of re-structuring, but also the taxation of not-for-profit organisations and foundations; of an individuals estate, (including European and International taxation issues); and tax planning choices as well as tax agreements with the fiscal authorities.

In addition to Belgian tax law, DBB advises on Franco-Belgian and International tax issues. DBB works with leading authorities on corporate law and real estate law to establish a multi-disciplinary approach taking legal, economic, financial and tax aspects into account. DBB collaborates regularly with accountants, company auditors and actuaries. Its professional network and international experience are among DBB's important assets.

The tax team co-operates with the Corporate, Real Estate and Private Client departments.

Mergers and acquisitions - divestments - liquidation - DBB carefully studies our clients’ corporate projects with a view to optimising the legal structures that allow them to function. It carries out due diligence on mergers and acquisition projects and liquidations and reviews the different stages of each transaction. It may also file requests for administrative arrangements with the relevant authorities.

Taxation of wealth - DBB assists executives and other individuals in asset and income planning over the course of life events (for example relocation, marriage, death, donations) and whether following expatriation or homecoming. The team specializes in the treatment of Franco-Belgian questions both as regards revenue and assets, for individuals and companies. Certain of DBB’s lawyers are dual-qualified and admitted as members of both the French and Belgian bars.

Taxation of real estate - DBB examines its client's real estate projects and scrutinizes particular arrangements (for example concerning the particular rules about long-leases referred to as "emphytéose-superficie" or “erfpachtgrond” in Belgian law) whilst proposing innovative solutions.

Taxation of not-for-profit organisations - The Tax team advises national and international foundations and not-for-profit organisations (including the Belgian asbl/vzw and aisbl/ivzw) structures.

Corporate taxation  - DBB’s legal advice on tax issues seeks to optimise client company’s structures and tax situation, whether at national or international, group, subsidiary, branch level (we also advise non-national executives on expatriate arrangements).

International Tax Treatment  - DBB regularly advises clients having regard to Belgian or International Tax rules [having regard amongst other matters to relevant double-taxation treaties].
