Competition law

Whether advising on restrictive agreements and practices or issues surrounding abuse of dominance DBB can provide you with both the national and EU (Articles 101 and 102 TFEU) competition law services that your business needs. National jurisdictions where we provide competition law services include in particular Belgium, Germany and the UK. We advise on national and cross-border mergers including those with a European dimension that are subject to mandatory prior notification to the European Commission.

Apart from making sure your agreements and market practices are competition law compliant, DBB’s competition services cover the setting up and running of compliance programmes; as well as training to help ensure that your company’s conduct does do not give rise to competition law issues in the first place. If such problems nevertheless arise, we can assist you in proceedings before EU and national competition authorities, including advising on dawn raids, leniency applications and settlement proceedings. Our lawyers advise both on complaints to the competition authorities and on complex cartel enquiries and investigations. Questions regarding the availability and compatibility of State aid are also part of the competition law team’s remit.

If litigation is necessary, we are able to commit experienced lawyers to write submissions and plead cases before national courts (in particular the Brussels Court of Appeal, which has a specialised competition law jurisdiction; the German courts; and the UK Competition Appeals Tribunal).
